Public Offer Agreement
1. General Provisions
1.1. This document constitutes a public offer (hereinafter referred to as the “Offer”) of the sole proprietor Ksenia Alekseevna Glybchenko (hereinafter referred to as the “Contractor”), addressed to any individual (hereinafter referred to as the “Customer”), to enter into an agreement for the provision of services under the terms and conditions specified below (hereinafter referred to as the “Agreement”).
1.2. In accordance with Article 437 of the Civil Code of the Russian Federation, this document is recognized as a public offer.
1.3. Full and unconditional acceptance of this Offer (acceptance) shall be deemed to occur when the Customer submits an application (form) on the website DolphinsTrip.com, makes payment for the services, or otherwise confirms consent by any means of communication.
1.4. The Agreement concluded by way of acceptance of this Offer does not require a bilateral signature and is legally binding.


2. Subject of the Agreement
2.1. The Contractor undertakes to provide the Customer with travel services, including the organization of sea voyages, retreats, freediving training, and related activities (hereinafter referred to as the “Services”), and the Customer undertakes to pay for the Services in accordance with the terms of this Agreement.
2.2. The list, scope, and conditions of the Services shall be specified on the website DolphinsTrip.com and/or agreed upon by the Parties via correspondence.

3. Terms and Definitions
For the purposes of this Agreement, the following terms shall have the meanings set forth below:
  • “Website” – the Internet resource located at DolphinsTrip.com.
  • “Services” – the travel, retreat, and related services provided by the Contractor to the Customer.
  • “Customer” – an individual who has accepted the terms of this Offer.
  • “Contractor” – sole proprietor Ksenia Alekseevna Glybchenko.
4. Rights and Obligations of the Parties
4.1. The Contractor undertakes to:
  • provide the Services in accordance with the terms of this Agreement and the description on the Website;
  • ensure the quality and safety of the Services provided;
  • provide the Customer with information necessary to receive the Services.
4.2. The Contractor has the right to:
  • involve third parties in the provision of the Services;
  • unilaterally change the schedule, program, or conditions of the Services due to weather, safety requirements, or other objective reasons, while preserving the overall nature of the Services;
  • refuse to provide the Services in case of improper fulfillment of obligations by the Customer, including failure to pay.
4.3. The Customer undertakes to:
  • pay for the Services in the manner and within the terms specified in this Agreement;
  • provide reliable information required for the provision of the Services;
  • comply with the safety instructions and recommendations of the Contractor and instructors;
  • not interfere with the provision of the Services.
4.4. The Customer has the right to:
  • receive the Services in accordance with this Agreement;
  • obtain from the Contractor information regarding the Services;
  • refuse the Services in the manner prescribed by this Agreement and applicable law.
5. Service Fees and Payment Procedure
5.1. The cost of the Services shall be indicated on the Website and/or in the invoice issued by the Contractor.
5.2. Payment shall be made in rubles or euros by bank transfer or other means specified by the Contractor.
5.3. The Customer’s obligation to pay is deemed fulfilled at the moment the funds are credited to the Contractor’s account.
5.4. The Contractor has the right to refuse the provision of Services if payment is not received in due time.

6. Cancellation and Refunds
6.1. The Customer has the right to cancel the Services at any time before the start of their provision, by notifying the Contractor in writing.
6.2. In case of cancellation by the Customer:
  • more than 30 calendar days before the start – refund of 70% of the amount paid;
  • from 30 to 14 days before the start – refund of 50% of the amount paid;
  • less than 14 days before the start – no refund.
  • 6.3. In case of cancellation by the Contractor for reasons not related to the Customer, the Customer shall be refunded the full amount paid.
  • 6.4. Refunds shall be made within 30 calendar days from the date of the corresponding request.
7. Liability of the Parties
7.1. The Parties shall be liable for failure to perform or improper performance of obligations under this Agreement in accordance with the legislation of the Russian Federation.
7.2. The Contractor shall not be liable for:
  • actions/inactions of third parties, including airlines, transport companies, and hotel services;
  • loss or damage of the Customer’s personal belongings;
  • health risks related to the Customer’s personal characteristics and/or failure to follow instructions.
  • 7.3. The Customer is personally responsible for the state of their health and safety when participating in activities, training, and freediving.
8. Force Majeure
8.1. The Parties shall be released from liability for partial or full failure to fulfill obligations if such failure was the result of force majeure circumstances (natural disasters, hostilities, strikes, changes in legislation, actions of government bodies, epidemics, etc.).
8.2. The term for fulfilling obligations under this Agreement shall be extended for the duration of such circumstances.

9. Term of the Agreement
9.1. This Agreement shall enter into force from the moment of its acceptance by the Customer and remain in force until the Parties fully perform their obligations.
9.2. This Agreement may be terminated by mutual consent of the Parties or unilaterally in accordance with the procedure established herein.
10. Confidentiality and Personal Data
10.1. The Contractor shall process the Customer’s personal data in accordance with Federal Law No. 152-FZ “On Personal Data” dated July 27, 2006.
10.2. By accepting this Agreement, the Customer consents to the processing of their personal data for the purpose of providing the Services, communication, order fulfillment, sending information and advertising materials.
10.3. The Customer may withdraw consent to the processing of personal data by sending a written notice to the Contractor’s email: DolphinsTrip.com@gmail.com.
11. Dispute Resolution
11.1. All disputes and disagreements arising under this Agreement shall be resolved by negotiation.
11.2. If the Parties fail to reach an agreement, disputes shall be referred to the court at the location of the Contractor, in accordance with the legislation of the Russian Federation.
12. Final Provisions
12.1. This Agreement constitutes the full agreement between the Parties and supersedes all prior negotiations and correspondence.
12.2. If any provision of this Agreement is held invalid, the remaining provisions shall remain in force.
12.3. The Contractor has the right to amend this Agreement unilaterally by publishing a new version on the Website.
